                   A RESOLUTION GRANTING A VARIANCE PURSUANT TO 
                   ARTICLE V, SECTION 1134 OF THE CHATTANOOGA 
                   ZONING ORDINANCE TO C. H. CHEN TO PLACE FILL 
                   AND A ROADWAY CULVERT IN THE FLOODWAY ZONE 
                   IN THE VICINITY OF MACKEY BRANCH CREEK AT 
                   BRANCH MILE 3.78, NORTH OF EAST BRAINERD AS 
                   INDICATED ON THE SITE LOCATION PLAN ATTACHED 
                   HERETO AND INCORPORATED HEREIN.
                   
                   
                                                     
                   
                   
       	    	 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF 
       CHATTANOOGA, TENNESSEE, That there be and is hereby granted a 
       variance pursuant to Article V, Section 1134 of the Chattanooga 
       Zoning Ordinance to C.H. Chen for the placement of fill and a 
       roadway culvert in the floodway zone in the vicinity of Mackey 
       Branch Creek at Branch Mile 3.78, North of East Brainerd as 
       indicated on the Site Location Plan attached hereto and 
       incorporated herein.
